It’s an uncomfortable week for ISPs and copyright owners. A 53-year-old grandmother has been cleared of accusations of downloading 18 films and TV shows, which initially resulted in a suspension of her Internet service.
Cathi Paradiso of Colorado had her Internet service suspended by Qwest after 18 claims of infringement were sent to her concerning content illegally downloaded from her network. Paradiso claimed to have never downloaded the content and said she was being wrongly accused.
After an investigation, Qwest found that her network had been compromised and that she was likely not responsible for the downloads. Paradiso has hired a lawyer, but it is unlikely that anything will come of any lawsuit.
Her Internet connection was used by a third-party because she left the wireless access unprotected. The crux of any argument will be whether or not a user should be penalized for not being knowledgeable about technology. While Paradiso will make the perfect martyr for those in favor of both piracy and loosening copyright restrictions on digital content, her trial will likely end up being more a case of personal responsibility and adherence to her contract with Qwest. |
